In accordance with Section 7 of the Building and Construction General On-Site Award 2010, an Employer and a Worker may agree to vary the application of certain terms of the award to meet the individual needs of the Worker and the Employer. The terms of this agreement are set out in this document. This Individual Flexibility Arrangement agreed between: Amrick Services (Aust) (ABN: 79 608 297 678) (‘Employer’) and You (‘Worker’)1. Commencement: This Individual Flexibility Arrangement will commence with full effect from the commencement date specified below and continue until terminated in accordance with clause 6: Termination.* I ('Worker') agree. Please tick to confirm your understanding and acceptance. 2. Instrument coverage: The Employee is covered by the Building and Construction General On-Site Award 2010 (‘Award’). Section 7 of the Award (Award Flexibility) allows the Employer and Worker to agree to vary the effect of certain terms of the Award to meet the genuine needs of both parties. To avoid doubt, this Individual Flexibility Arrangement will not change the effect the Award has in relation to the Employer and any other employee.* I ('Worker') agree. How terms will be varied: The Employer and Worker agree to vary the effect of the terms of the Award set out in clause 3 of this Individual Flexibility Arrangement in that time worked between the 9th and 38th hour will be paid at the relevant ordinary time pay rate, provided those hours are worked between 7:00am to 3:30pm Monday to Friday within a single week. These hours may be averaged in accordance with the award. Any hour worked thereafter, or outside of the above parameters, will be paid at the overtime rate as specified in the Award.* I ('Worker') agree. Employee better off overall: The Employee will be better off overall under this Individual Flexibility Arrangement than the Employee would have been if this Individual Flexibility Arrangement had not been entered into because the Worker obtains first right of refusal for the opportunity to accept and conduct additional work when the Worker on the chance that the Worker is available and has no other commitments at the time, thereby receiving the opportunity to work when the Worker may otherwise not have been.* I ('Worker') agree. Please tick to confirm your understanding and acceptance. 6. Termination: Either party may terminate this Individual Flexibility Arrangement by providing 4 weeks’ notice in writing. If notice is given, the Individual Flexibility Arrangement will cease to operate at the end of the notice period. The Employer and the Worker may however agree, in writing, to terminate this Individual Flexibility Arrangement at any time. This Individual Flexibility Arrangement will cease to operate upon cessation of the Worker’s employment with the Employer. If this Individual Flexibility Arrangement is terminated for any reason, the terms of the Award will apply in relation to the Worker’s employment.* I ('Worker') agree.
